Arrest of vessels for foreign maritime lien

The Full Court of the Federal Court has delivered the much anticipated appeal decision in the “Sam Hawk”.

The “Sam Hawk” was arrested in Australia by bunker suppliers on the basis of an asserted maritime lien that arose by choice of US and/or Canadian law in the bunker supply contract, where each recognise a maritime lien for the supply of bunkers.    Click here to read full article.
